This privacy policy applies to www.flyflair.com and related sites and web applications, collectively referred to as “Flair Digital Properties,” which are owned and operated by Flair Airlines Ltd. (“Flair” or the “Carrier”).

How we define personal information

Personal information refers to details unique to an identifiable individual. We only collect the personal information necessary to provide our services to you. "Personal information" includes your full name, address, telephone number, date of birth, email address, and any other information unique to you alone. This information helps identify who you are and may be used to contact you if necessary to complete your purchase.

Additionally, we request your gender to assist in estimating the aircraft’s total load and to help us identify you for legal, security, and aviation regulatory compliance purposes. You are only required to disclose your gender if your itinerary includes international travel.

Personal information becomes known to Flair only when you provide it directly to us, or when a third party, such as a friend or family member, books travel on your behalf with your consent. These third parties are referred to as "assistants" in booking travel.

If you request a customized service, we may also need to collect additional personal information, as described below.

As standard practice, Flair will collect personal information, and use or disclose it, with express consent or consent provided by someone assisting you with booking travel. When you book travel on www.flyflair.com, you are added to our email list. This list may be used to contact you occasionally with offers from Flair Airlines Ltd. that we believe may be of interest to you. You can withdraw your consent at any time by scrolling to the bottom of any email and clicking “unsubscribe,” then following the brief instructions.

Occasionally, we may send you service-related emails. These are not promotional emails; rather, they provide important information such as flight-related updates or purchase confirmations made on www.flyflair.com.

Flair will collect, use, and disclose personal information about passengers with their knowledge and consent, unless otherwise required or permitted by law. Before collecting personal information, Flair will identify the purposes and limit its collection, use, and disclosure to those purposes.

In certain circumstances, personal information may be collected, used, or disclosed without the passenger’s knowledge or consent. For example:

  • Legal, medical, or security reasons may make it impossible or impractical to seek consent.
  • Seeking consent might defeat the purpose of collecting the information, such as in cases of fraud detection or law enforcement.
  • Consent may be impossible or inappropriate when the passenger is a minor, seriously ill, or has a mental health condition.

When and how personal information is collected

Flair limits the collection, use, and disclosure of personal information to what is required and reasonable under the circumstances. During your use of the website, in the provision of services, or otherwise, you may be asked to voluntarily provide personal information for purposes such as:

  • Providing you with the services (including flight and hotel bookings)
  • Contacting and corresponding with you regarding your transactions (including payment issues), your use of the services, and providing customer care services
  • Facilitating transactions, processing orders, and payments for services
  • Developing, delivering, and improving services
  • Administering and facilitating your participation in contests and promotions related to the services
  • Processing and responding to your inquiries and requests, and administering Flair's relationship with you
  • Facilitating and enhancing your use of the website
  • Developing, delivering, and improving services and advertising
  • Conducting surveys or questionnaires related to the services
  • Flair may also develop a confidential profile for you, which will be used to provide services and enhance your use of the website. Additionally, Flair may keep a record of all communications with you.

Flair will not sell or rent your personal information. However, personal information may be disclosed in the following circumstances:

(a) To Flair travel agents, suppliers, and service providers for use in matters related to your use of the website, Flair's promotional activities, or the provision of services

(c) As required by law or if Flair believes it is necessary to comply with the law
Flair will require third parties to protect personal information in a manner consistent with this Privacy Policy and all applicable laws.

When a passenger purchases a ticket, makes a flight booking, or when a third party does so on their behalf, Flair requires certain personal information to complete the transaction. This may include, at Flair's discretion, the passenger's name, gender, address, email address, telephone number, and payment information. This information is necessary to identify the passenger, contact them, and complete the purchase process.

Flair may use this information for commercial or operational purposes, including current and future bookings, and may also use it for marketing and related purposes. If a passenger fails to provide adequate or accurate information, Flair is not liable for any damages resulting from the passenger not receiving communication from Flair, including communications about schedule irregularities or other matters.

Accountability

Flair uses contractual means to ensure that passengers' personal information is protected whenever a third party is engaged to perform services on Flair's behalf. This includes, but is not limited to, services related to information technology, data processing and storage, research, marketing, conducting surveys, and customer relations.

In some instances, these third parties may be located outside of Canada and may be required to disclose information to government authorities in those countries.

Cookies and other technologies

Flair's website, online services, email messages, and advertisements may use "cookies" and other similar technologies, such as web beacons, pixel or gif tags, and action tags. These technologies collect information that helps Flair improve products and services, advertising, customer communications, and the overall customer experience.

Flair treats information collected through cookies and similar technologies as non-personal information, except for internet protocol (IP) addresses or other similar identifiers. These technologies can reveal your anonymous previous website visit history to us. Additionally, other websites you visit after leaving www.flyflair.com may be able to identify that you visited our site.

Please note that the details of your web history may disclose enough information to reduce or eliminate your anonymity on our site or on other sites. This is an inherent limitation of third-party advertising technology, which is beyond Flair's control.

Compliance with government authorities

There may be situations in which Flair is required by government authorities to collect, use, or disclose personal information about a passenger, without the passenger’s knowledge or consent. This may occur based on the passenger’s boarding location and destination.

Information that Flair may be required to collect by government authorities includes, but is not limited to: the passenger’s full name, date of birth, citizenship, gender, passport number and country of issuance, visa number (including ETA or ESTA), permanent resident card number, payment method for the flight, details of how the flight was booked, and any other personal information as set out in this policy or as required by such authorities.

Passengers acknowledge that Flair may be obligated, under applicable laws, to provide Canadian, U.S., or international government authorities with access to their personal data. As such, any information Flair holds about a passenger and their travel arrangements may be disclosed to the relevant authorities of any country included in the passenger’s itinerary.

Cross-border information

Flair may use third-party providers for information technology, data processing, reservation services, data storage, and other related services. Flair ensures that personal information shared with these third-party service providers is protected by contractual obligations of confidentiality and non-disclosure.

Personal information, including medical information covered by this policy, may be processed or stored in the United States. As a result, such personal information may become accessible to U.S. government authorities and agencies under lawful orders issued pursuant to U.S. federal and state laws.

Special needs

Flair is committed to accommodating the needs of passengers with special requirements, subject to certain restrictions. When a passenger has special needs, Flair may need to collect additional personal information, including health-related details, to assess whether our aircraft and staff can accommodate the individual’s travel needs.

For passengers requesting additional services, such as special meals, oxygen, stretcher services, or accommodations for disabilities, Flair or its agents may collect further personal information that would not otherwise be required. Depending on the specific needs, Flair may also request emergency contact information for a third party.

This information will be kept on file and handled in accordance with the Flair Privacy Policy. When a medical authority makes travel arrangements for a passenger, the passenger consents to the release of personal information to the medical authority, including, but not limited to, itinerary changes and payment details. Additionally, Flair and its service provider may disclose travel and arrival information to the attending medical authority at the destination.

For minors traveling unaccompanied, Flair and its service provider will require the contact information of the individual meeting the minor at the destination or transfer point. The contact information of the minor’s parent or guardian must also be provided for use in case of an emergency.

Flair travel profile

Creating a profile with Flair offers you the convenience of saving both time and money. By choosing to set up a profile, your personal information is securely stored in our database, allowing for easier booking and management of your travel with us. A profile is also required to receive or use any Flair flight or travel credits.

When you create a profile, our system will automatically populate the required fields during flight bookings, streamlining the process. You can update or modify your profile information at any time under "My Trip" or "My Profile."

If you choose to opt in to certain email services, Flair may, with your consent, collect additional details such as your hotel and car preferences, along with other information like your date of birth. This information will be used to personalize communications and offer relevant services based on your preferences.

Cancelling your profile

You may cancel your profile at any time. Please note that doing so will permanently cancel any flight or travel credits associated with your profile. Additionally, your information will no longer be automatically populated in fields during future bookings.

To cancel your profile, please use our Contact Us form.

You may create a new profile at any time, even after cancellation; however, this will not reinstate any previous flight or travel credits.

Promotions, contests, and sweepstakes

From time to time, Flair may offer promotions, draws, or contests. When you enter a contest or draw, we will ask for personal information such as your name, date of birth, phone number, email address, and home address so we can contact you if you win.

In some cases, we may need to verify that you meet the minimum age requirement or other eligibility criteria specified in the contest rules. Additional information related to the promotion or contest may also be requested, as required by law.

Email marketing

We use email and targeted online advertising to send you updates on products and services, promotional offers, and other marketing communications based on the information we collect about you, such as your email address, general location, and purchase and website browsing history. We process your personal data in accordance with our Privacy Policy.

You can withdraw your consent or manage your preferences at any time by clicking the unsubscribe link at the bottom of any of our marketing emails, or by emailing us at marketing@flyflair.com.

Social media widgets

Our pages integrate plugins from the social network Facebook. An overview of the Facebook plugins can be found here: http://developers.facebook.com/docs/plugins/. When you visit our site, the plugin establishes a connection between your browser and the Facebook server. Facebook thereby obtains information that you have visited our site, including your IP address.

If you are logged into your Facebook account and click on the Facebook “Like” button, you can link the content of our pages to your Facebook profile. As a result, Facebook may correlate your visit to our site with your user account.

Retention

Personal information is retained only for as long as necessary to fulfill the purposes for which it was collected, as well as for legal or business purposes. Personal information used to make a decision that directly affects you will be retained for at least one year. Once personal information is no longer required, it will be securely destroyed.

Access and accuracy

The Carrier makes reasonable efforts to maintain the accuracy, completeness, and currency of a Passenger's personal information, based on the data provided by the Passenger or a third party acting on their behalf. The Carrier will provide means for the Passenger to update their personal information as needed, except where prohibited or restricted under the Contract of Carriage.

Safeguarding personal information

Flair recognizes the importance of securing personal information against loss, theft, unauthorized access, disclosure, copying, use, modification, or disposal. To safeguard personal information, Flair employs a combination of physical, administrative, and technological measures, tailored to the sensitivity of the information and the format in which it is held. However, while we strive to maintain strong security measures, it is important to note that no security system is completely infallible, and Flair cannot guarantee that personal information will not be accessed or disclosed in ways not covered by this Privacy Policy.

Limiting collection

Passengers who do not wish to be contacted about special offers, marketing, research, surveys, or any other purposes not directly related to the provision of purchased services for a specific flight should inform the Carrier of their preference at the time of booking.

Third parties

The Website may include links or references to other websites operated by third parties. This Privacy Policy does not apply to those websites, and Flair has no responsibility, liability, or control over how third parties collect, use, or disclose your personal information. Your use of those websites and dealings with such third parties are at your own risk.

Third-party bookings and changes to bookings

If a third party, including a family member, friend, or work colleague, seeks to make a booking on a Passenger's behalf, that third party may be asked to provide the Carrier with the same personal information that the Carrier would normally collect from the Passenger directly to complete the transaction. Unless and until the Carrier is advised otherwise, the Carrier considers that such a third party has the Passenger's consent and authorization to provide the Carrier with the Passenger's personal information and to make bookings (and changes thereto) on the Passenger's behalf in accordance with the Carrier's privacy policy set out in this Tariff.

Please note that the collection, use, and disclosure of the Passenger's personal information by a third party is subject to the Passenger's dealings with the third party and any applicable privacy policies and practices the third party may have.

If a third party who has booked the Passenger's current flight or other travel service, or who otherwise has the Passenger's full name and booking reference, contacts the Carrier and seeks information about the Passenger's booking or wishes to make changes to it, the Carrier will disclose the Passenger's booking information. The Carrier may, in its sole and absolute discretion, allow such a third party to make changes to the Passenger's booking, to the extent such changes are permitted under the Contract of Carriage, and the Carrier is acting reasonably in concluding that the Passenger has given the third party their consent to do so.

If the Passenger does not want a third party to obtain information about or make changes to their booking, the Passenger should not share their booking reference with any third party.

Services agreements

The agreements that you accept when you order the Services contain important provisions, including provisions that disclaim, limit, or exclude Flair's liability, as well as provisions that determine the applicable law and exclusive jurisdiction for the resolution of disputes. To the extent permitted by applicable law, each of these provisions applies to any dispute that may arise in relation to this Privacy Policy or Flair's collection, use, and disclosure of your personal information, and they have the same force and effect as if they had been reproduced directly in this Privacy Policy.

Revisions to privacy policy

Flair reserves the right to modify this Privacy Policy at any time, without prior notice or liability to you or any other person. The collection, use, and disclosure of your personal information will be governed by the version of the Privacy Policy in effect at that time. New versions of the Privacy Policy will be posted on the Website and are available upon request. Your continued dealings with Flair, subsequent to any changes to this Privacy Policy, will signify your consent to the collection, use, and disclosure of your personal information in accordance with the updated policy.
